why I hate/love the topic
The victim’s role should always been kept neutral. Now this is what we should all love when discussing property crime in karachi, and I personally believe the Pakistani laws can do more about victims of crimes in Pakistan. And especially for the Karachi cases where the victims and criminals are so entangled with the police force or political entities or the other powerful stakeholders that it makes it impossible for the victims. But still they hold right to take law against the culprit, even it seems challenging. As Pakistan’s law is not fully designed keeping victims in mind as an actor rather than as an obstacle in between the offenders and the judge or policymakers so it is crucial to discuss these problems and find ways out of this. However, victims should be neutral throughout the entire case.
My field anecdotes courtroom tactics related to the topic
So, as a victim of property crime I had several experiences working with law enforcement agencies. In Pakistan, when you hear of crime or robbery committed outside the area where you were supposed to hear the crime committed, it often leads to speculation among people saying that some government resource have facilitated it, and they would always take it in that manner no matter which court it goes to as long as the case has no witnesses of standing on their shoulders in that case the police officer or investigator, whoever might have helped and facilitated that crime by taking the bribe at a specific period may get away unaccounted for, and he should also come and bear witness and the victim should bear a grudge forever on those government officials or officers. If the perpetrator of such crime doesn’t appear in any court it leads everyone to blame the legal and the law enforcement agency, who might have done that crime itself.
Local law practices, small regulation quirks
Now when we have this information of facilitation coming into light and victim is suffering from such situation, there is a big concern and confusion about legal rights of victims of property crime here, in Pakistan, specifically karachi, a lot of information is circulating in public domains without a proper fact checking, or sometimes, they contradict each other. Also I know for sure that many people especially among law practitioners are giving them half truth or making their concerns more problematic, and misleading by making them hope or promise to do it and they fail to deliver. My personal opinion
My Professional war stories (legal consulting, courtroom floors, academia)
- Art 19 and Art 33 protect our personal properties. So, victims need no compensation under the circumstances they did try here commit or indulge themselves in illegal or corrupt practices, as Art 33 imposes the responsibility on property owners themselves to provide security to ensure their property. The law has set various standards for compensation, so victim needs not expect unrealistic or unfair compensation claims as many lawyers in this city may deceive their clients or even manipulate. Victims, they do deserve their legal rights, which should be protected by authorities.
